Pakistan Election: Pakistan's Supreme Court to conclude
hearing Musharraf's reelection case October
31, 2007
Justice
Javed Iqbal, heading the bench, made
it clear during the proceedings on Tuesday that the hearing
would be completed by Friday because one member of the
bench would not be available next week, the APP report
said.
Attorney
General Malik Muhammad Qayyum in his
arguments on Monday pleaded that the petitions filed by
Wajihuddin Ahmed, Makhdoom Amin Fahim, Liaqaut Baloch
and others were not maintainable.
Abdullah
Khan Dogar, the counsel for a petitioner Dr. Anwarul Haq,
said the same person could not be elected two times by
the same parliament and such a step would be undemocratic.
At
one stage, Justice Javed Iqbal observed
that there was much talk about democracy but supremacy
of parliament had not been touched upon. Referring to
detailed judgments in Pakistan Lawyers Forum case, Iqbal
said the Supreme Court had already held that parliament
was the only forum for legislation.
The
Attorney General would resume his arguments on Wednesday
as Abdullah Khan Dogar had completed his arguments Tuesday,
according to the direction of the bench.
Two
presidential candidates, former Justice Wajihuddin Ahmed,
and Pakistan People's Party Parliamentarians (PPPP) chief
Makhdoom Amin Fahim had challenged the candidacy of Musharraf
to contest the presidential election and had asked to
the court to stay the election.
The
supreme court ruled on Oct. 5 that the presidential election
should be held as scheduled but barred the Election Commission
from announcing official notification of the results until
a final verdict was given.
